Welcome to the Hemera Foundation website (the “Site”) provided by the Hemera Foundation and operated by Hemera Regnant, LLC (collectively, “we” or “our” or “us”).  This privacy policy applies to the use of visitors and donors accessing the Site and describes the types of information we collect from our Site or that you provide to us through other means, how we may use that information, to whom and under what circumstances we may disclose it, and how we protect it.  By using this Site or voluntarily providing personal information to us, you consent to the terms of this Privacy Policy.  If you do not agree to the policy, please do not use the Site.

We may modify this Privacy Policy at any time and will post the current version on the Site. We encourage you to periodically review our Privacy Policy to stay informed about how we are using the information we collect.

1.  Collection of Information

Information Collected Automatically

Each time you visit the Site, we may automatically collect certain types of information. Some examples of automatic information we may collect are as follows:

  • Your IP address, MAC address, browser type, operating system, device-identifying information, type of computer, and type of Web browser software, the specific webpages visited during your connection, and the domain name from which you accessed the Site.

  • Information about your browsing behavior, such as the date and time you visit the Site, the areas or pages of the Site that you visit, the amount of time you spend viewing the Site, the number of times you return to the Site and other clickstream data.

  • We may use “cookies” of different types to recognize your computer.  A cookie is a small text file that a website, online application, or e-mail may save to your internet browser and/or your computer’s hard drive for use in subsequent visits to the Site or other sites.

We may use web beacons, match scripts, pixel tags or similar technologies that allow us to know if a particular web page was visited, an e-mail opened, or links in the email utilized.  In some instances, these technologies may allow us to match activities with particular users.

Information You Give to Us

We may collect personal information, such as your first and last name, email address, postal address, and telephone number that you provide when you interact with us.  Some examples are when you:

  • Sign up to receive a newsletter or email communications from us;

  • Register for one of our events;

  • Apply for a grant;

  • Register or create an account on the Site;

  • Correspond or communicate with us by phone, e-mail or otherwise;

  • Complete a survey; or

  • Use social media to interact with us, or to share something from our Site with others, we will receive information about what you share and other details that may be based on your social media privacy settings.

In some jurisdictions, individuals may have the right to opt-in or withdraw consent for certain uses.  If you reside in such jurisdictions, you may have additional rights which are detailed in Section 6 below.

2.  Use of Information

We may use information about you for purposes described in this Privacy Policy or disclosed to you on the Site.  For example, we may use information about you:

  • For editorial and feedback purposes;

  • For marketing and promotional purposes;

  • To create a statistical analysis of users’ behavior;

  • To review Site usage and operations;

  • To protect the security or integrity of the Site and our organization;

  • For content improvement;

  • To customize the content and layout of the Site;

  • To post your comments or statements on any blog or other online forum maintained on our website and other websites; or

If you sign up for our mailing list, we will send you informational emails about offers of services. At any time, you can ‘unsubscribe’ yourself from our email list simply by clicking the ‘unsubscribe’ button. 

3.  Disclosure of Information

We may disclose information collected from and about you as follows: (1) to our service providers to perform a business, professional or technical support function for us; (2) to our marketing partners, advertisers or other third parties, who may contact you with their own offers; (3) as necessary if we believe that there has been a violation of the Site Terms of Use or of our rights or the rights of any third party; (4) to respond to legal process (such as a search warrant, subpoena or court order) and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and (5) to protect the rights and intellectual property of the Hemera Foundation.  We may also disclose your personal information with your express consent.  We may share aggregate, non-personally identifiable information about Site users with third parties. 

Please note that if you voluntarily submit any personal information for posting on the Site, such as a review or a blog post, the information becomes publicly available and can be collected and used by others, so you should use care before posting information about yourself online. 

4.  Cookies Policy

The Site uses “cookies,” which are small pieces of information stored by your browser or other application on your computer's browser or hard drive.  The cookies are used to connect your computer with information stored about your online activity, searches, and preferences both within the same website visit and from one visit to the next on the Site and/or other websites.  Some examples of this data include your account preferences, user specific information on pages accessed, searched terms or addresses entered, and previous visits to the sites.  We use both session ID cookies and persistent cookies. A session cookie expires when your browser is closed, and a persistent cookie may stay on your hard drive for an extended period. Session cookies make it easier for you to navigate our site; persistent cookies can perform such activities as storing your password for forums or blogs so you do not have to sign in every time you visit those areas, and/or may be used to enable us to track and target the interests of our users so as to enhance the overall experience of using our Site.

The “help” portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive new cookies or how to disable cookies altogether.  If you reject cookies, you may not be able to participate in certain activities or receive a promotion tailored to you.  The Site does not control and does not guarantee the effectiveness of browser-based tools for managing cookies.

We or our partners may also use Flash cookies (also known as Local Stored Objects) or other similar technologies. A Flash cookie is a small data file placed on a computer using Adobe Flash or similar technology that may be built into your computer or downloaded or installed by you to your computer. We use these technologies to personalize and enhance your online experience, facilitate processes, and personalize and store your settings. Flash cookies may help our website visitors to, for example, set volume preference associated with a video experience, play games and perform surveys. 5.  Links to Other Websites

This website may contain links to other sites that are not controlled in any way by us. Please be aware of this when you click on any such links; we are not responsible for the privacy practices and/or policies of any website other than our own. Consequently, we strongly suggest that you review the privacy policy of every website you visit, whether or not they are linked to by our own site.

6.  Legal Basis for Processing Data and Data Protection Rights Under General Data Protection Regulation (GDPR)

If you are in the European Economic Area (EEA), our legal basis for collecting and using the personal information described in this Privacy Policy depends on the personal data we collect and the specific context in which we collect it.

We may process your personal data because:

  • We need to perform a contract with you;

  • You have given us permission to do so;

  • The processing is in our legitimate interests, and it is not overridden by your rights; or

7. Retention of Personal Information

Personal information that we collect, access or process will be retained only as long as necessary for the fulfilment of the purposes for which it was collected, unless otherwise provided in agreements between you and the Hemera Foundation or as required or authorized by law. Personal information that is no longer required to fulfill the identified purposes will be destroyed, erased or made de-identified. 

8.  Data Security 

We maintain reasonable and appropriate measures designed to maintain information we collect in a secure manner. We have taken certain physical, electronic, and administrative steps to safeguard and secure the information we collect from visitors to the Site. Even though we follow reasonable procedures to try to protect the information in our possession, no security system is perfect, and we cannot promise, and you should not expect, that your information will be secure in all circumstances.

9.  Third Party Websites

The Site may contain links to third-party websites, such as social media sites like Facebook and Twitter, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy policy posted on any external site before disclosing any personal information. Please contact those websites directly if you have any questions about their privacy policies. 

10. Changes to this Privacy Policy

We may change this privacy policy from time to time, including as required to keep current with rules and regulations, new technologies and security standards. When we do, we will post the change(s) on our Site. If we change the policy in a material and retroactive manner, we will provide appropriate notice to you.

11. Children’s Privacy

Under Age 13

Our Site is not specifically directed toward children, and we do not knowingly collect personal information from persons under the age of 13 on our Site without verifiable parental consent. If we learn that a child under the age of 13 has submitted personally identifiable information online without parental consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law).  If you become aware of any personally identifiable information, we have collected from children under 13, please contact us at info@hemeraregnant.org or by calling 720-235-0290.

Under Age 18

Minors under 18 years of age may have the Personal Information that they provide to us through the Site deleted by sending an email to info@hemeraregnant.org requesting deletion.  Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.

12.  Do Not Track

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, the Hemera Foundation and the Site do not recognize DNT.

13.  Your California Privacy Rights

California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information.  As discussed elsewhere in this Privacy Policy, we do not currently share the personal information of California residents with third parties for their own direct marketing purposes.  However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.

14.  Visitors from Outside the United States—Cross-Border Transfer

The Site is hosted in the United States. If you are visiting the Site from outside the United States, your information may be transferred to, stored and processed in the United States or other countries in accordance with this Privacy Policy.  The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions. By using the Site and/or providing personal information to us, you consent to transfer of your information to our facilities as described in this Privacy Policy
